The terms for
using Emiko.
These Terms and Conditions govern your use of Emiko's website, app, subscriptions, AI features, and related services. By using Emiko, you agree to them.
Emiko covers more than workouts. These terms apply to movement tracking, walk tracking, food and cravings support, recovery support, onboarding questionnaires, daily guidance, coaching, analytics, attribution, subscriptions, notifications, and related features.
1. Wellness Use Only
Important: Emiko is a wellness and educational product, not a medical service, medical device, or emergency service.
- No diagnosis or treatment: Emiko does not diagnose, treat, or cure PCOS or any other condition.
- Use judgment: You should consult an appropriate qualified professional before making significant exercise, food, or health changes.
- Stop if needed: If you feel pain, dizziness, faintness, or unusual distress, stop using the activity immediately and seek appropriate care.
- PCOS support is still wellness support: Emiko may be designed around PCOS needs, but it does not replace your doctor, dietitian, therapist, trainer, or emergency care.
2. What the Service Includes
Depending on your plan and available features, Emiko may include:
- AI-guided workouts, rep counting, and posture guidance.
- Walk tracking using available device step or motion data.
- Food, meal, cravings, and hunger-related support.
- Recovery and daily support content.
- Questionnaire-based personalization and changing recommendations over time.
- Coach or continuity support where applicable.
- Push notifications, reminders, analytics, attribution, and subscription features where enabled.
Features may change, be updated, or be removed as the product evolves.
3. AI and Personalization Limits
- Estimation-based outputs: rep counts, form prompts, calorie estimates, food estimates, and personalized suggestions are based on software models and the information available. They are not guaranteed to be perfect.
- Questionnaire dependence: some recommendations depend on the accuracy and completeness of the information you provide. If your inputs are incomplete or inaccurate, the suggestions may be less useful.
- Environmental limits: camera angle, lighting, device performance, and other context can affect workout guidance quality.
- AI limits: AI-generated food, workout, craving, recovery, and coaching-style responses can be incomplete, wrong, or not suitable for your situation. Use them as guidance, not as a final medical decision.
4. Accounts and User Responsibilities
- Accurate information: you agree to provide information that is reasonably accurate, especially where it affects personalization, billing, or safety-related guidance.
- Account security: you are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
- Personal use only: your account is for your own personal wellness use unless we agree otherwise in writing.
- Permissions: camera, motion, notifications, photos, and tracking permissions are controlled by your device and browser settings. If you turn them off, some features may become less useful or unavailable.
5. Subscriptions and Payments
- Recurring billing: paid plans may renew automatically unless cancelled according to your billing settings.
- Web billing: web subscriptions may be processed through Dodo Payments or another web payment provider.
- Android billing: Android app subscriptions may be processed through Google Play Billing.
- iOS billing: iPhone app subscriptions may be processed through Apple In-App Purchase once enabled. Apple's terms, refund rules, and subscription-management flows apply to Apple purchases.
- Cancellation: you may cancel future renewals, but access already paid for may continue until the end of the active period. If your subscription is managed by Apple, Google, or another provider, you must cancel through that provider's subscription settings.
- Account deletion is separate: deleting your Emiko account does not automatically cancel a subscription controlled by Apple, Google, or a payment provider.
- Refunds: unless required by law or stated otherwise in a specific offer, past subscription charges are generally non-refundable. App Store and Play Store refund decisions may be handled by Apple or Google.
6. Tracking, Analytics, and Attribution
Important: Emiko uses analytics and attribution. A personalized app with ads, onboarding, subscriptions, and product debugging cannot run blind.
- PostHog: we may use PostHog for product analytics, page/route events, feature usage, user properties, and masked session replay.
- Meta: we may use Meta Pixel, Meta Conversions API, Meta Android SDK, and Meta iOS SDK for ad attribution and app/web events such as page views, registration, trials, leads, and subscription events.
- Google Tag Manager: public website pages may use Google Tag Manager to manage analytics and marketing tags.
- Consent and platform controls: your device, browser, Apple App Tracking Transparency choice, Android settings, and ad platform controls may limit some tracking.
- No promise of zero tracking: if you use Emiko, you agree that necessary product analytics, diagnostics, attribution, security, and billing events may be processed as described in the Privacy Policy.
7. Device Features, Push, and App Stores
- Camera: camera-based movement guidance depends on camera permission, lighting, device angle, and device performance.
- Motion and steps: walk tracking may use native Android services, iOS Motion & Fitness/Core Motion, or browser capabilities depending on your platform.
- Notifications: reminders and push notifications may use Firebase/Android push, browser web push, or Apple APNs/iOS push when enabled. Delivery is not guaranteed.
- App Store terms: when you use Emiko through Apple App Store or Google Play, those store rules and platform terms also apply.
8. Coaching and Human Support
Some plans may include coach or continuity support. That support is subject to normal operational limits.
- Professional conduct: abusive, harassing, or inappropriate behavior toward coaches, staff, or support channels may result in account suspension or termination.
- Not emergency support: coaching is not a live emergency or crisis service.
- Operational limits: response times may vary and are not guaranteed to be instant.
9. Intellectual Property
Emiko, its software, designs, branding, written content, personalization systems, AI flows, and related materials remain the property of Emiko or its licensors. You receive a limited, revocable, non-transferable license to use the service for personal wellness purposes.
You may not copy, resell, reverse-engineer, or commercially exploit the service except where the law clearly allows it.
10. Suspension, Deletion, and Termination
We may suspend or terminate access where necessary for safety, payment failure, abuse, fraud, legal compliance, or material breach of these terms.
You may request account deletion. Some records may be retained where required for billing, tax, fraud-prevention, security, legal compliance, or dispute handling. Subscription cancellation may still need to be completed through the payment provider that controls your renewal.
11. Liability Limits
To the maximum extent permitted by law, Emiko is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service or specific outcomes, and we are not liable for indirect, incidental, or consequential losses arising from your use of the service.
12. Privacy
Your use of the service is also governed by our Privacy Policy, which explains what data we collect, including questionnaire data, personalization data, analytics, attribution, tracking, billing records, AI processing, notification data, and device-permission data.
